Ensemble Inc. (“we”, “us” or “our”) values your privacy. In this Privacy Policy (“Policy”), we describe how we collect, use, and disclose personal information when you access and use our website https://www.ensembleos.com or https://app.ensembleos.com (the “Site”), the Performing Arts Operating System software tools and services (“Services”) that are made available through the Site or the Company’s mobile applications available for iOS and Android devices (the “App”). The Services, Site, and App are collectively referred to as the “Platform”.

By visiting or using the Platform or providing us your personal information, you agree that your personal information will be handled as described in this Policy.

Capitalized terms in this Policy that are not defined in this Policy shall have the meanings set forth in our Terms of Service.

The Information We Collect About You

We collect personal information about you directly from you and from third parties, as well as automatically through your use of our Platform. “Personal information” for purposes of this Policy means information that identifies or relates to you and is protected as personal information or personal data under laws applicable to us.

Information We Collect Directly From You and Third Parties. We collect personal information directly from you in several ways:

End User Registration: If you are an individual that registers an account to use the Platform, we collect your name and email address. We may also collect your credit card information in order to process payments for use of the Platform, which information is provided directly to payment processors we engage for this purpose.
Optional Information: End Users can also optionally provide additional information about themselves or other End Users they authorize to use the Platform under their account. This may include the following: Location, Pronouns, Gender, Phone number, Date of birth, Company, Height, Vocal range, Dance Experience, Special Skills, Resume, Past Roles (Role, Theater, Director, Month/Year), Health notes (allergies, injuries, accessibility), Ethnicity, Race, School District, Parent / Guardian (Full name, Email, Phone number, Street address, Unit/Apt, City, State, ZIP code, Relationship (Mother, Father, Legal Guardian, Grandparent, Other), Emergency Contact Full Name, Emergency Contact Phone Number.
Operation of the Platform: The Platform is used for managing performing arts productions and events. The Platform provides the following features:
- Communications in the form of postings and direct and group messaging to other End Users.
- Resources in the forms of documents and images uploaded to the Platform.
- Rehearsal scheduling which may include associating individual performers with roles and rehearsal schedule dates.

Use of these features involves the End User providing personal information to the Platform and potentially to other End Users, including photos, videos, audio, location information, activities, roles, skills, performances and other information.

Additional features including connecting performing arts professionals, fundraising activities, volunteer tracking etc.

Visitors to Site: you view the Site without providing personal information (except that collected automatically as noted below). You can also complete “Contact Us” forms on the Site, which collect your name, email and any message you wish to provide.

Information We Collect Automatically. We may automatically collect the following information about your use of our Platform through cookies and other technologies: your domain name; your browser type and operating system; web pages you view; links you click; your IP address; your mobile or other device ID; your advertising ID; the length of time you visit our Platform; and the referring URL, or the webpage that led you to our Platform. We may combine this information with personal information that we have collected about you, including, where applicable, your name and other personal information. Please see the “Our Use of Cookies and Other Tracking Mechanisms” section below for more information.

Use of Platform by Minors – Notice to Parents/Legal Guardians of Privacy Practices

Any person under the age of 13 — or under the higher minimum age required by the law of their state of residence — ("minors") can only use the Platform with the consent of their parent or legal guardian. We will not collect personal information directly from End Users who are minors unless we have received the verifiable consent of their parent or legal guardian, as required by the Children's Online Privacy Protection Act and applicable state law, before allowing them to use the Platform and before sending marketing about our products or services. When we collect, use or share the personal information of minors, we take additional steps to protect their privacy, including:

Transparency: We explain what information we collect, how we use it, whether we share it, and with whom.
Data minimization: We collect and use only the personal information reasonably necessary to provide the Platform. Limited retention: We keep personal information only for as long as reasonably necessary to provide the Platform as described in this Policy.

Adults and minors can choose whether or not to share their personal information with us. Some features of our Platform, however, won’t function if users haven’t given us their information. In such cases, we only ask for information that is reasonably necessary to use the Platform.

The personal information we collect from minors is described in the section entitled The Information We Collect About You. In general, this is profile information that parent or legal guardian may choose to provide when registering an account for their minor child (e.g. name, email address, age, skills, etc.). In addition, if a minor is authorized by a parent to use the Platform, we may collect additional personal information from the child in connection with their use of the Platform as described in the section entitled “Operation of the Platform” and certain persistent identifiers as described in the section entitled Information We Collect Automatically. This could include the following:

Name, email and phone numbers.
Communications with other users on the Platform.
Skills, background and health information if shared by the parent or child.
Video or audio files or photographs that the child or others may share in connection with performances being managed by the Platform.
Schedules for performance and rehearsal.
Location data relating to the use of the App and minors attendance at rehearsals and sessions.

In the United States, parents and guardians have the right to review, delete, and refuse further collection or use of their child’s personal information under COPPA and many comprehensive U.S. state privacy laws. Some comprehensive state privacy laws grant individuals additional rights to their personal information, including the right to access, portability, correction, deletion, restriction, opt-out, withdraw consent, appeal, and request list of third parties who process that personal information (Oregon and Minnesota residents only). How We Use Your Information

We use your information, including personal information, for the following purposes:

Provide the Platform. We use your personal information to provide the Platform, communicate with you about your use of the Platform, respond to your inquiries, and provide customer service.
Personalization. We use your personal information to tailor the content and information that we may send or display to you, to offer location customization, personalized help and instructions, and to otherwise personalize your experiences while using the Platform.
Improve and Develop Our Platform. We use your personal information to: (a) ensure our Platform is working as intended; (b) operate our business; (c) better understand how users access and use our Platform, both on an aggregated and individualized basis, (d) develop, maintain, protect and improve our Platform, (e) train any artificial intelligence and machine learning or large language models we may employ in connection with our Platform, and (f) perform research and analytics, including to analyze and report on usage and performance of our Platform.
Marketing and Promotions. We use your personal information for marketing and promotional purposes. For example, we may use your personal information, such as your email address, to send you news and newsletters, special offers, and promotions, or to otherwise contact you about products or information we think may interest you or.]
Compliance. We may use your personal information to: (a) detect, investigate, and prevent activities on our Site that may violate our Terms of Service, could be fraudulent, violate copyright or other rules, or that may be otherwise illegal, (b) comply with legal requirements, (c) defend or exercise legal claims, (d) respond to law enforcement or governmental investigations or requests, and (e) protect our rights and the rights and safety of our users and others.

How We Share Your Information

We may share your information, including personal information, as follows:

Consent. Where you have provided consent, we share your information, including personal information, as described at the time of consent.
Other Users. One of the features of the App is that it allows for communications and interactions between End Users. You acknowledge that your personal information that is provided in such communications and interactions may be shared with the other End Users.
Affiliates. We may disclose the personal information we collect from you to our affiliates or subsidiaries solely for the purpose of providing the Platform to you; however, if we do so, their use and disclosure of your personal information will be maintained by such affiliates and subsidiaries in accordance with this Policy.
Service Providers. We may disclose the information we collect from you to third party vendors, service providers, contractors, or agents who perform functions on our behalf.
Business Transfers. If we are acquired by or merged with another company or entity, if substantially all of our assets are transferred to another company or entity, or transferred as part of a bankruptcy proceeding, or are in negotiations for any of these types of transactions, we may transfer the information we have collected from you to the other company or entity.
In Response to Legal Process. We also may disclose the information we collect from you in order to comply with the law, a judicial proceeding, court order, or other legal process, such as in response to a subpoena or in response to requests from law enforcement authorities.
To Protect Us and Others. We also may disclose the information we collect from you where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Use or this Policy, or as evidence in litigation in which we are involved.
Aggregate and De-Identified Information. We may share aggregate or de-identified information about users and their use of the Platform with third parties and publicly for marketing, advertising, research or similar purposes.

Our Use of Cookies and Other Tracking Mechanisms

We use cookies and other tracking mechanisms, such as web beacons, to track information about your use of our Platform. We may combine this information with other personal information we collect from you (and our third party service providers may do so on our behalf).

Currently, our systems do not recognize browser “do-not-track” requests. You may, however, disable certain tracking as discussed in this section (e.g., by disabling cookies), but such disabling will impair use of the Platform.

Cookies. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our Platform, while others are used to enable a faster log-in process or to allow us to track your activities at our Platform. There are two types of cookies: session and persistent cookies.

Session Cookies. Session cookies exist only during an online session. They disappear from your computer when you close your browser or turn off your computer. We use session cookies to allow our systems to uniquely identify you during a session or while you are logged into the Site. This allows us to process your online transactions and requests and verify your identity, after you have logged in, as you move through our Site.
Persistent Cookies. Persistent cookies remain on your computer after you have closed your browser or turned off your computer. We use persistent cookies to track aggregate and statistical information about user activity.

In addition, we, our service providers and others sometimes use data-gathering mechanisms on the Site, including without limitation “web beacons”, “clear GIFs”, “pixels” and/or “tags” (“Tracking Technologies”). These perform statistical and administrative functions, such as measuring site and page traffic, verifying advertising paths, better understanding user interests and activity, gathering related information (such as information relating to a particular browser, device or IP address), and positioning images, and typically do so without detracting from your online experience.

We generally use the following types of cookies and Tracking Technologies on our Site:

Strictly Necessary Cookies. These cookies are necessary for the Site to function and cannot be switched off in our systems. They are usually only set in response to actions made by you which amount to a request for services, such as setting your privacy preferences, logging in or filling in forms. You can set your browser to block or alert you about these cookies, but some parts of the Platform will not then work.
Functional Cookies. These cookies enable the Site to provide enhanced functionality and personalization. They may be set by us or by third party providers whose services we have added to our pages. If you do not allow these cookies then some or all of these services may not function properly.
Performance Cookies. These cookies allow us to count visits and traffic sources so we can measure and improve the performance of our Site. They help us to know which pages are the most and least popular and see how visitors move around the Site. All information these cookies collect is aggregated. If you do not allow these cookies we will not know when you have visited our Site, and will not be able to monitor its performance. One of the services we use for these purposes is Google Analytics. By accessing and using our Platform, you consent to use of cookies and Tracking Technologies and our sharing of information collected through cookies and Tracking Technologies with third parties for data analytics, site performance and advertising purposes.

Disabling Cookies. Most web browsers automatically accept cookies, but if you prefer, you can edit your browser options to block them in the future. The Help portion of the toolbar on most browsers will tell you how to prevent your computer from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Visitors to our Site who disable cookies will not be able to browse certain areas of the Site or use the Platform.

Third-Party Links

Our Platform may contain links to third-party websites. Any access to and use of such linked websites is not governed by this Policy, but instead is governed by the privacy policies of those third-party websites. We are not responsible for the information practices of such third-party websites.

Security of My Personal Information

We have implemented commercially reasonable precautions to protect the information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our efforts, no data security measures can guarantee 100% security.

You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

What Rights Do I Have Regarding My Personal Information

You may request access, a copy, modification, or deletion of personal information that you have submitted to us by contacting us at help@ensembleos.com. We will use reasonable efforts to accommodate such requests to the extent required by law, provided that we may be required to retain personal information to comply with legal obligations, accounting requirements, or for other business purposes. We may request additional information to verify the identity of the requesting party before responding to a request. Please note that copies of information that you have updated, modified or deleted may remain viewable in cached and archived pages of the Site for a period of time.

What Choices Do I Have Regarding Use of My Personal Information for Marketing?

We may send periodic promotional or informational emails to you. You may opt-out of such communications by following the opt-out instructions contained in the e-mail. Please note that it may take up to 10 business days for us to process opt-out requests. If you opt-out of receiving emails about recommendations or other information we think may interest you, we may still send you e-mails about your account or any Services you have requested or received from us.[1]

Location of Personal Information

Our Platform is offered from and currently intended for use only in the United States. We store any personal information we collect in the United States. If you access the Platform from outside the United States, you agree to the transfer of your information to the United States, which may have less protections for your personal information than your jurisdiction of residence.

Changes to this Policy

This Policy is current as of the Effective Date set forth above. We may change this Policy from time to time, so please be sure to check back periodically. We will post any changes to this Policy on the Site. If we make any changes to this Policy that materially affect our practices with regard to the personal information we have previously collected from you, we will endeavor to provide you with notice in advance of such change by highlighting the change on our Site or if you have an account with us, providing notice to the email address in your account (for this reason you should make sure to update your account information promptly if it changes).

California Shine the Light Law: In addition, under California Civil Code § 1798.83, California residents who have provided personal information to us may obtain information regarding our disclosures, if any, of personal information to third parties for third-party direct marketing purposes. Requests must be submitted to the following email address: help@ensembleos.com. Within 30 days of receiving such a request, we will provide a California Privacy Disclosure, which will include a list of certain categories of personal information disclosed during the preceding calendar year to third parties for their direct marketing purposes, along with the names and addresses of the third parties. This request may be made no more than once per calendar year.
